As we have repeatedly noted, identity theft is a multi-billion dollar problem. Many companies have responded to this threat by upgrading their security procedures. However, some companies and agencies continue to put their customers and patients at risk. This week, the Kentucky-based Cabinet for Health and Family services announced that it may have disclosed the personal information of 2,500 people. Reports indicate that the stolen data includes names and addresses. This breach is unfortunate, but data breaches are now all too common.
Indeed, Adam Levin, the Director of New Jersey’s Department of Consumer Affairs, just wrote a thoughtful article exposing the Government’s “epic fail” in protecting people from data breaches. Disclosure of personal information and medical information is unlawful, and we have brought lawsuits on behalf of victims of such disclosures in the TRICARE/SAIC, Zappos, Sutter Health and Saint Joseph data breaches.
