On November 9, 2012, our attorneys. filed a class action in Federal District Court for the Central District of California against Hyundai Motor America, Inc. (“Hyundai”) and Kia Motors America, Inc. (“Kia”) (collectively, “Defendants”) on behalf of all consumers that purchased or leased certain 2011-2013 model year Hyundai or Kia vehicles on which the Defendants overstated the vehicles’ gas mileage and fuel efficiency ratings. Over the past two years, Defendants uniformly misrepresented the fuel economy ratings and gas mileage estimates many of their vehicles. The uniform misrepresentations and omissions relating to their vehicles’ fuel economy ratings and gas mileage estimates stem from Defendants’ failure to comply with Environmental Protection Agency (“EPA”) testing procedures relating to fuel economy and gas mileage estimates.
As a result of Defendant’s misrepresentations, Plaintiff purchased a vehicle whose gas mileage estimates and fuel economy ratings were higher than they would have been had Defendants complied with EPA test procedures. The lawsuit filed seeks to redress this unfair, deceptive, and otherwise improper business practice that Defendants employed against unsuspecting consumers.
