Yesterday, in a tentative ruling, a Federal Court denied a motion to dismiss a class action lawsuit accusing Johnson & Johnson of falsely advertising that its high SPF Aveeno Active Naturals sunscreen products offer more sun protection than lower SPF sunscreen products. Unfortunately, the Court tentatively ruled that the plaintiff in the case could not pursue claims involving products she did not purchase. Since the plaintiff only purchased the 100+ SPF Aveeno sunscreen, claims on behalf of purchasers of Aveeno sunscreens with SPF 70 and 85 are in danger of falling by the wayside.
