If you bought AT&T’s prepaid GoPhones on the promise of a cheap plan only to find out only more expensive calling plans were available, you may have a claim against AT&T. Eriz Zatt, an AT&T customer from California alleges that he is a victim of this “bait and switch” practice. He bought AT&T’s GoPhone to avail of the $0.10 per minute plan for nationwide calls. When he tried to activate the plan, he realized that the plan was not available and that only more expensive plans were. But for the $0.10 per minute call advertised on the GoPhone packing, he would not have bought the GoPhone. As such, he filed a class action lawsuit against AT&T in California federal court for false and misleading advertising, fraud, negligent misrepresentation and unjust enrichment.
