Not all cosmetic products live up to their promised claims.
The Food & Drug Administration (“FDA”) recently issued several warning letters to various cosmetics manufacturers including Michael Todd True Organics LLC and Peter Thomas Roth LLC, alleging several violations under the Federal Food, Drug and Cosmetic Act 21 U.S.C.§ 321.
The FDA’s letters took issue with the companies’ product advertising, and noted that these products may not be “safe and effective” for their referenced uses. Michael Todd True Organics LLC products at issue include the Intensive Cream Eye Treatment and Knu Cream Anti-Aging Face Lift Serum. Products from Peter Thomas Roth LLC include the company’s Un-Wrinkle Turbo Line Smooth Toning Lotion and Mega-Rich Intensive Anti-Aging Cellular Eye Crème.
Without the proper substantiation, these companies labeling claims may constitute false and deceptive advertising.
