FDA and FTC Warn Companies Selling Products With Delta-8 THC For Misleading and Deceptive Packaging That Could Be Mistaken For Children’s Snacks

The FTC and FDA reviewed and sent cease-and-desist letters to the following companies who sell Delta-8 tetrahydrocannabinol edible products: Hippy Mood (Levittown, Pennsylvania); Life Leaf Medical CBD Center (Murrells Inlet, South Carolina); Shamrockshrooms.com (online only); Mary Janes Bakery Co. LLC and Miami Rave LLC (Miami, Florida); and Earthly Hemps (Cape Coral, Florida), after finding that their advertising may violate the FTC Act’s prohibition against “unfair or deceptive acts in the marketplace, including practices that present unwarranted health or safety risk.” The companies were warned about manufacturing and marketing edibles products containing Delta-8 tetrahydrocannabinol in packaging that are similar to children’s snacks. The packaging, including the logo resembles popular kids snacks such as: Nerds candy, Nabisco Chips Ahoy cookies, Kellogg’s Froot Loops cereal,

Selling products in packaging similar to children’s snacks shows neglect for consumer safety and wellbeing.
