On January 30, 2023, U.S. District Judge Philip M. Halpern, of New York, appointed Todd Garber as co-lead counsel in a consolidated national litigation against Somnia Inc., in a case concerning a data breach announced in September 2022. See Chabak v. Somnia, Inc., 22-CV-09341 (S.D.N.Y).

Somnia Inc. Data Breach Resulted In Theft of Highly Sensitive Information
Somnia Inc. is a physician-owned anesthesia management service with at least five entities operating in states including New York, Washington, California, and Virginia (See table below for a list of affected practices).
On September 22, 2022, Somnia Inc. announced that it had been the subject of a massive cyber-attack exposing thousands of patients’ personally identifiable information. The data breach resulted in the theft of thousands of patient records, which include data regarding patients’ social security numbers, dates of birth, driver’s license numbers, financial information, health insurance policy numbers, Medical Record Numbers, Medicaid or Medicare IDs, and health information such as treatment and diagnosis information.
The class action lawsuit alleges that Somnia had been aware of significant cyber security vulnerabilities for years yet failed to take adequate measures to prevent the breach.
