In September 2023, an advisory panel to the Food and Drug Administration (“FDA”) agreed unanimously that the active ingredient, phenylephrine, in these medications, is ineffective to relieve nasal congestion. This vote will prompt the FDA to consider the advisory committee’s input and the discussed evidence, and it may lead them to take further action, which the attorneys at FBFG will investigate.

Notably, the advisory committee’s discussion and recommendations are only related to orally administered phenylephrine, and not the nasal spray form. Associated Press News has reported that CVS Health is voluntarily pulling oral cold and flu treatments that list phenylephrine as the only active ingredient.
