FDA Issues Warning Letter to H2 Beverages, Inc. for Selling Hydrogen-infused water beverages as medical treatment

If you have ever bought or drank H2 Beverage’s Hydro Shot, Silver Bullet Green Tea with Zinc, and Hydro Brew Unsweetened green tea, you may have been misled about the beverages’ medicinal properties.

The FDA issued a warning letter to H2  Beverages, Inc. regarding these above-listed beverages.  The FDA stated, “Your Hydro Shot, Silver Bullet Green Tea with Zinc, and Hydro Brew Unsweetened Green Tea products are intended for treatment of one or more diseases that are not amenable to self-diagnosis or treatment without the supervision of a licensed practitioner.  Therefore, it is impossible to write adequate directions for a layperson to use your products safely for their intended purposes.  Accordingly, [these beverages] fail to bear adequate directions for their intended use, and therefore, the products are misbranded under Section 501(f)(1) of the FD&C Act [21 U.S.C. 352(f)(1)].”

On its website, H2 Beverages allegedly stated that “Hydrogen water has been shown to stabilize cholesterol, . . . fight inflammation, protect against radiation damage, ameliorate gastrointestinal disorders . . .” and that “Molecular hydrogen . . . This anti-inflammatory little beast stabilizes cholesterol levels.”

The attorneys at Finkelstein, Blankinship, Frei-Pearson & Garber, LLP have successfully recovered tens of millions of dollars in overcharges for consumers.  (Prior results do not guarantee similar outcomes). We are currently investigating whether H2 Beverages may have unlawfully marketed their goods.  If you or someone you know purchased or drank a  “Hydro Shot, Silver Bullet Green Tea with Zinc, and Hydro Brew Unsweetened Green Tea” please contact us to discuss your legal options.
